These Terms of Service ("Terms") govern your use of the Bad Beats™ application ("Service"), operated by Bad Beats ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Description of Service
Bad Beats is a bet scoring tracker that allows users to upload images of sports betting slips, track their performance, and share results with friends. The Service uses AI to parse bet slip images and ESPN data to track game scores. Bad Beats is not a sportsbook and does not facilitate gambling or wagering of any kind.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you are of legal age and that your use of sports betting services complies with all applicable laws in your jurisdiction.
3. Accounts
- You must provide a valid email address and verify it to access all features.
- You are responsible for maintaining the security of your account credentials.
- You may not create accounts using automated means or on behalf of others without their consent.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
- Upload images that do not contain sports bet slips or related content.
- Upload, post, or transmit user content (including profile photos / avatars) that is illegal, hateful, sexually explicit, harassing, infringes on rights of publicity, or impersonates another person.
- Attempt to circumvent rate limits, security measures, or access controls.
- Use the Service to spam, harass, or send unsolicited communications to other users.
- Use automated tools, bots, or scrapers to access the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Impersonate another person or misrepresent your identity.
5. Prohibited Content and Enforcement
Uploading illegal, obscene, or harmful content (including but not limited to child sexual abuse material, non-consensual imagery, or content that violates any law) is strictly prohibited and will result in:
- First offense: Immediate 24-hour account suspension.
- Second offense: Permanent account ban.
- Illegal content: Immediate permanent ban and referral to law enforcement authorities.
All uploaded images are screened before processing:
- AI content screen. Images are evaluated by AI to confirm they depict sports bet slips. Images that do not appear to be bet slips are rejected and never stored on our servers. Repeated upload rejections (3 or more within 24 hours) trigger automatic account suspension.
- Edge CSAM scan. When images are served, Cloudflare's CSAM Scanning Tool compares image hashes against the NCMEC database. Matches are reported by Cloudflare to NCMEC's CyberTipline.
We maintain an audit log of rejected uploads (user ID, timestamp, and rejection reason) but do not retain the rejected images themselves. Safety-incident records (hash match details, account metadata, IP address) associated with illegal content are retained indefinitely for legal compliance and law-enforcement cooperation.
Zero Tolerance: Child Sexual Abuse Material (CSAM)
We maintain a zero-tolerance policy for child sexual abuse material (CSAM) and all forms of child sexual exploitation content. Any user who uploads, transmits, or attempts to distribute CSAM through the Service will be subject to:
- Immediate and permanent account ban with no possibility of reinstatement.
- Mandatory reporting to the National Center for Missing & Exploited Children (NCMEC) via their CyberTipline, in compliance with 18 U.S.C. § 2258A.
- Referral to law enforcement, including all available account information, metadata, and associated records.
- Preservation of all evidence and associated account data as required by federal law.
This policy applies regardless of intent, context, or claimed purpose. There are no warnings or second chances for CSAM violations.
To detect Child Sexual Abuse Material (CSAM), uploaded images are scanned by:
- Anthropic's safety filter at the time of upload. Images that trigger Anthropic's content policy are immediately rejected and the user is banned.
- Cloudflare's CSAM Scanning Tool when images are served. Cloudflare compares image hashes against the National Center for Missing & Exploited Children (NCMEC) database. Matches are reported by Cloudflare to NCMEC's CyberTipline.
Bad Beats also files independent reports of detected CSAM to the NCMEC CyberTipline at https://report.cybertip.org/.
Avatar Uploads
Profile photos (avatars) are processed using the same safeguards as bet slip images:
- Anthropic content check at upload time. Images that trigger Anthropic's safety filter are rejected and the buffer is quarantined for review.
- Cloudflare CSAM scan when avatars are served via Cloudflare. Hash matches against the NCMEC database are reported to NCMEC's CyberTipline.
- EXIF stripping. Location data and other camera metadata are removed before storage to protect user privacy.
6. User Content
- You retain ownership of user content you upload to the Service, including bet slip images and profile photos.
- By uploading content, you grant us a limited license to process, store, and display it as necessary to provide the Service.
- We may remove content that violates these Terms without notice.
- You are solely responsible for the user content you upload and share, including profile photos.
6a. User Reports, Blocking & Moderation
Bad Beats relies on user reports to surface objectionable content. Each user can:
- Report any avatar via the in-app report flow. Bad Beats reviews reports and removes content that violates these Terms within 24 hours.
- Block other users. Blocked users' avatars and content are hidden from the blocker's view. Blocked users are not notified.
Bad Beats reserves the right to remove avatars and suspend accounts at its discretion when content violates these Terms.
7. AI Processing
Uploaded bet slip images are processed using third-party AI services (Anthropic's Claude API) to extract bet information. Images are sent to these services for processing and are not retained by Anthropic per their API terms. We may use the structured data extracted from your slips (teams, odds, bet types) to improve parsing accuracy, but your original images are not stored for training purposes.
8. Accuracy Disclaimer
The Service relies on third-party data sources (ESPN) for game scores and AI for bet slip parsing. While we strive for accuracy, we do not guarantee that scores, bet parsing, or evaluation results are error-free. The Service is for informational and entertainment purposes only. Do not rely on it for financial decisions.
9. Premium Subscription and Payments
Bad Beats offers an optional Premium subscription that removes ads and unlocks features such as full archive access and CSV export of your bet history.
- Pricing: Premium is $4.99 USD per month (or local currency equivalent set by Apple). The price displayed in the upgrade screen at the time of purchase is the price you pay.
- Billing: Subscriptions are processed by Apple through the iOS App Store. We never see or store your payment details.
- Auto-renewal: Premium subscriptions renew automatically each month at the then-current price until you cancel. Your iTunes account is charged within 24 hours prior to the end of the current period.
- Cancellation: You can cancel at any time from your iOS device: Settings → [your name] → Subscriptions → Bad Beats → Cancel Subscription. Cancellation takes effect at the end of the current paid period; you retain Premium access until then.
- Refunds: Refunds for App Store purchases are handled solely by Apple under their policies. To request a refund, go to reportaproblem.apple.com.
- Restoring purchases: If you reinstall Bad Beats or sign in on a new device with the same Apple ID, tap Restore Purchases on the upgrade screen to reactivate your subscription.
- Free tier: All core bet-tracking features remain available without a Premium subscription. The free tier is supported by ads.
10. Intellectual Property
The Service, including its design, code, branding, and features, is owned by Bad Beats. You may not copy, modify, or distribute any part of the Service without our written permission.
"Bad Beats" and the Bad Beats logo are our trademarks. You may not use the Bad Beats name, logo, or branding in any manner that suggests endorsement by or affiliation with us without our prior written consent.
11. Termination
- You may delete your account at any time through the account settings.
- We may suspend or terminate your account for violations of these Terms.
- Upon termination, your data will be deleted in accordance with our Privacy Policy.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POUDROUGH PROJECTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL.
14. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
